I want to get my Level 1 license in Secutary of State with my step dad but im not sure if he is a legal guardian. His adress on his license is my adress and he lives here. I need an answear ASAP.

If he and your Mom are married then YES he can act as your legal guardian without any problems. He assumed 50% responsibility for you when he married her. I say get him and go for it! Good luck!

If you have another birth parent that is still living then I don't think he is. Unless he has signed guardian papers. I'm not sure but I have a friend with a step-mom who is trying to become the legal guardian of her and I think there is a long process she has to go through. I hope this has helped.

The answer is no. Your only legal guardians are your birth parents; an adoptive parent or someone whom the court has appointed as your guardian.

A legal guardian is a court-appointed adult to act as your parent and has the court paperwork to prove it.

A step-parent has limited authority and would have to adopt you in order to become the legally recognized parent

Your stepfather is considered to be a legal stranger to you unless your mother or your father have given him the right to act as your legal guardian. They would need to have a power of attorney activated so that he can sign papers for you. The only other way for him to have a legal voice for you would be for him to adopt you.

I work with the juvenile court system daily as a probation officer. I have to frequently tell stepparents that I cannot reveal details to them about their step children unless one of the legal parents gives me permission to do so.

When the juvenile offenders are in court, the judge will not allow the stepparents in the courtroom unless the parents and the child agree for the stepparents to be there. Otherwise, they are kept out of the courtroom, just like any stranger off the street would be prohibited from coming into the courtroom to watch a juvenile legal proceeding..

Your stepfather as long as he is married to your mother has a totally legal relationship with you as a parent! That would only cease if he divorced your mother!

There is no such thing as Guardianship by a parent! That is used mainly when someone other than your parents are appointed by a court! The State usually, and sometimes a relative!

Some say that they are your legal guardians, when actually they are your parents . not guardianns, and have physical custody, not guardianship!

If they get married then he may still have to go to court, but only if her mother/father, the father's mother/father or close family member fights him having custody of the children. And if the friend that has the tumor will write out a will leaving custody of the children to her husband, then it's pretty certain that he'll get to keep custody of the children.

yes they can. sometimes{certain situations} they will have to legally adopt you but in most cases they dont and as long as your parents are married,yes
