An African American fire fighter in CA just won several million $$ because his white coworkers put dog food in his food and laughed while he ate it. If he can win millions for being a poor sport, I figure anyone can win anything. But if you are contemplating it, you need to think about your own future, whether in the same company or trying to find a new job. Sometimes when someone claims sexual or racial discrimination, it's to hide the fact that they aren't very good at their job-- if anyone criticizes them, they claim discrimination, and the courts have been sympathetic. If you win the millions, you don't have to worry about keeping your job, but if you don't... If you decide to sue, be sure you have documented the incidents, have witnesses, and report it internally first. Good Luck!!

I am assuming "the company" didn't make the remarks, but allowed another employee to get away with doing so, yes?
You can sue the company for failure to supervise and for allowing a hostile work environment to prevail.
You also need to contact the EEOC because it sounds as though you are being discriminated against.

the fast answer is sure, yet why would you? human beings used to artwork issues out by speaking with one yet another. Now, it form of feels that once someone receives their thoughts damage or doesn't get their way about something the first element they pick to do is come across a legal professional and document a lawsuit. i'm no longer declaring that you would no longer have grounds for a lawsuit, yet frankly i imagine there are extra useful techniques in which to handle a topic which includes this. first of all what have you ever finished to objective to resolve this in the corporate structure? maximum organizations have an inner attitude to coping with this type of subject. i'd exhaust all avenues in the business corporation previously leaping on the lawsuit bandwagon. If it were me and that i might want to no longer make sure the topic in the business corporation i'd locate yet another position with yet another business corporation. in case you document a lawsuit hostile on your corporation corporation you probable gained't have a job with the business corporation. in case you've been waiting to save the interest it probable does no longer be a reliable surroundings in which to artwork.

Companies usually have policies for dealing with these kinds of things. If you have gone up the chain of command all the way to the CEO/president/whoever and the problem has not been solved, you could go talk to a lawyer and see if you have a case.

yes but make sure u go through the chain of command with complaints or have witnesses or you probably cannot build a case. Read your employee handbook on steps to take and don't be afraid to stand up for your civil liberties. I went through the same thing.

Depends on who makes them. If it's just a coworker you can file a complaint or grievance with the employer. If it's a surperior, yes you can sue.

I would recommend you talk to someone about the language. If the company does nothing or is not willing to do anything, then you will have a better case.

Yes, it doesn't mean you will win. If you lose, you might get fired. Without any details, it's hard to say.
