it depends on how the video tape was obtained. There are different statutes in almost every state so you should check that out for your state. If it turns out that the video was illegally obtained then it cannot be used in court.

most states are "no-fault" divorce states. the tape would probably not be a factor. check with your lawyer.

The judge would use it to make his/her decision-it'll show whose at fault for the marriage ending and who'll have to pay alimony, etc.
