There is probably nothing you can do legally to prevent them from using the word Hawaiian on their website.

The first thing I would do is get in the car, drive over to Lanakai and speak to them face to face about the problem.

If you have a friendly personality and possibly several friends and business contacts in common, they might be sympathetic to your cause.

You can suggest that they change the word "Hawaiian" to "Hawaii" so people don't get confused. The more generic word "Hawaii" has a greater volume of queries anyway.

Hawaii is a small place and you don't want to rub people the wrong way.

If that doesn't work, drive back with a cease and desist order and see what happens.

In the US, the (r) is for a registered Trademark - nothing to do with copyrights - In the meantime, you can use 'tm' next to the name - that Unregistered Trademark - you have to pay to do a trademark search -usually with a patent/trademark attorney - google "registered trademark process India" or something similar to find info online - not sure of Trademark process in India
