She told her current boyfriend that she refused her child support payments so that they will qualify for there LOW INCOME apt. Because if they make to much they can not stay there. As far as I know you can not refuse to take child support. Is there a rule about that anywhere?

BTW.... I happen to think this makes lots of single parents who need the help look really bad!
Like me.
I mean there are people all over the world fighting for a little help from the other parent. I just don't understand her decision....As to many of her other decisions.
But I guess a friends a firend ?!

I really doubt that she would be able to refuse it, especially under those circumstances. Generally (and it depends on your state's laws), child support is not a payment that is owed to the mother. It is a benefit that actually belongs to the children. The court would have to determine that refusing child support is in the best interests of the children in order for it not to be ordered.

In your friend's circumstance, I doubt it would happen. Child support waivers are usually allowed when both parents are well-off and neither one needs the money and the custodial parent can adequately care for the child without child support. But even in those circumstances, it is rare for a court to approve such an arrangement.

I would suggest your friend contact a family law attorney in her area if she's real serious about it, especially since there may be some public assistance fraud issues as the other responders have mentioned.

It could come back to bite her in the *** later. If she refuses it... later on it could be used as evidence of her need. A judge could rely upon her refusal of child support in a court when setting the appropriate amount at a later date... and kids have 18 years to grow up so that's essentially a long term axe to have hanging over her head.

However, most applications consider child support income "optional" for privacy reasons. Therefore, she MAY be able to have her cake and eat it too... providing that the application lists child support income as optional to report.

perhaps she meant that she did not apply for it in the first place. you cant refuse payments that are legally owed to you by the government, but you could contact them saying that your situation has changed and the payments are no longer essential (like you have more money incoming than the threshold).

what she has done only serves a purpose if it means the child/ren are better off this way. if they suffer, she needs euthanasia.

I don't know about the law, but it is certainly unethical. Besides, the child support is probably more than the apartment subsidy. (depending on where she lives - in my area the apartment subsidy is only about $320/mo)

Yes. She is committing welfare fraud by refusing to report income available to her.
