All legit business are required to conform to workers comp regulations.

It depends where you are and what are the laws. I have worked for comapnies that were with workers comp and others that had private insurance.
If you opt out you better have Liability insurance. It is more beneficial to you as an employer to be associated with Workman's compensation.
