Thanos. He's killed exactly half of the entire Marvel Universe before using the Infinity Gauntlet. Dr. Doom has the power to do so, as does The Sphinx, Magneto, Apocalypse, Graviton, Terrax, Tyrant, Magus, Grandmaster, The Void, etc.

Post civil war the most evil marvel villian would be captain america and the secret avengers who refuse to register in direct defiance of the law. Or more directly speedball who was responsible for the deaths of over 100 children in stanford and refuses to take responsibility.
the most evil in DC is probably bane. As the joker isn't really evil he is just psycotic and was created by batman, thus batman is responsible for all the things joker has done.
EDIT: maybe we should start a seperate civil war question for this. but no. You see the nazi germany example simply doesn't fit. we are not talking about a mass genocide situation here or an unjust or unreasonable request.
The law was enacted to prevent a group of costumed people from running around unchecked. Not to create mass genocide and have people assist them with it. Last time I checked, in all comic universes and reality vigilantism as practiced by these comic heroes is illegal. the government just looked the other way. Iron Man's way makes them register thier powers like a gun, those fighting it want to be able to anonymously assault, commit arson (or did you think the human torch was just shooting fake flames?) and recklessly damage property and people and not be held accountable because they wear a mask. Captain America didn't even bring a legal challenge to the law or work within the system he immediately became a criminal and took it upon himself to start a revolution. The law was enacted by the duly elected legislature and signed into law by the president. Democracy in action. If Cap doesn't like the american way, he should change his name. Starting a revolution because he doesn't like a law that is equivalent to firearms registration is an evil act. He should stop acting like a whiny b itch and show respect to the country that he pretends to represent. Aside from the heroes fighting the premise of the civil war is pretty flimsy because of this and the gross mishandling of captain america's character. He works within the system. Iron Man would be the one more likely to defy the government. Marvel severely screwed up in the writing. It is however still entertaining.

Marvel, I'm starting to think it is Iron Man, for the way he deceived Spider Man into revealing his identity publicly, and keeping people who were not captured on the battlefield in the Negative Zone, permanently, as was shown in the most recent issue of Civil War.
Even if Spider Man defeats Stark, he has now shot himself in the foot, revealing his identity. Now that everybody knows, if Stark withdraws his protection from Aunt May and Mary Jane, at least one of Spider Man's many, many enemies must eventually get them. That is just so low down, dirty and disgusting, to me.
DC wise, I can't remember the guy's name, but he knew Superman's secret identity and was attacking all Clark's closest friends in order to provoke the Man of Steel and get him to lose his temper and do something evil, like striking back in revenge. That is the kind of thing that real criminals would do.
It is not the Luthors and the Kingpins, the Darkseids and the Thanoses with their grand schemes, but the grubby little ones, who are just in it for the cruelty.

The most evil in marvel is Apocalypse. He can't be stop. He keeps coming back no matter how many times he's destroyed. The most evil in DC is the Mr. Freeze... He kills cause he doesn't have any emotions.

I see Apocalypse as more like Galactus, more of a force of nature (in this case evolution) than anything else. Doom and Luthor are complex, driven by some noble and not-so-noble obsessions.
The wizard and the evil god are just plain evil.

Take out the ones who are only doing their jobs (I mean, c'mon: Mephisto doesn't exactly have a choice, does he?), and you have:
- Lex Luthor for D.C.: that bastich is all about himself
- Tony Stark for Marvel: the road to Hell, buddy...
