Santa can go to jail if...
he broke the law ala going into peoples houses without consent. and even though he would not be committing robbery. It would still be breaking and entering or at least trespassing. But Santa moves so fast that no cop could catch him and no district attorney would try him for political reason. And to find a jury of his peers would require you to track down not one but multiple fictitious characters.
So the only reason he would go to jail would be to deliver coal to convicts.

Santa is pure and good, he would never do anything that would result in jail.
