had an argument will a bullying business owner that decided to bill me for her frustration with me. I had an answering service for about 3 months. The worst service imanigable. I filed a complaint with the BBB and the owner called me to refund my money because she wanted to resolve the complaint. I was refunded the money I paid and was offered 3 months free service to see if they could get their act together. 30 days went by and the service got worse plus I received a bill even though my service was supposed to be free. I called the owner back and politely explained I wanted to cancel and she went over the edge. Cursed at me and said that now I owe her $400. I have proof from her stating I owe her nothing, now I received a final bill for $400 saying if I dont pay up in 48 hours she is going to sell the debt to a collection agency....... and place it on my credit. I responded with a letter stating that that is illegal and if she does I will file suit... what are my options?? HELP!

you are right on track.this one is a slam dunk.though you are doing every thing right you need to contact your attorney generals office because she is adopting unfair and illegal business practices.this PERSON IS HAVING SERIOUS FINANCIAL PROBLEMS AND IS TRYING TO TAKE IT OUT ON YOU,You sound like you have enough fight in you.go get her.If I were you I would start by sending her a certified letter indicating intent to file charges against her for double dipping,and to file a $5000 dollar small claim against her for attempt to defraud.if she goes ahead with her claim to send your "bill"to a collections agency she is only giving you additional ammunition for your claims.If this thing appears on your credit you can get it removed by showing that this is an attempt to at distortion.It will also give you the additional info.you need for a successful claim.

I think your best bet would be to call a small claims lawyer for a free consultation or -any- lawyer in that field for a free consultation to see what they think the best bet would be. Than of course, they don't get paid until you get paid. Or , try reasoning with the woman scanning in the proof that you have that you don't need to pay and e-mailing it to her. Save a copy of hte e-mail in your sent folder if it's an e-mail with the date and time and everything. Save every peice of proof you have. If you have a phone conversation record it or write everything down with the time and numbers. Hope that helps!

go back to the bbb, also file a fraud complaint with the police, make copies of all of your paper work, put the originals in a safe lock box, let your public servants do their thing on her, states atty can do wonders if you word the complaint properly, good luck.

maybe beat her to the punch file in small claims court see if you can get a judgement against her so she has no standing to sell debt to collection agent not a lawyer so this is just a guess

You have the proof...so she loses. Make sure you use word of mouth, a wonderful tool in the business world, eventually she will get the reputation she deserves.

I would ask her to take me to court, once there all will be sorted out, you may even get damages.
