I've been thinking...(Scary as it sounds...)
I'm 22. Let's say I live in Alabama. (In Alabama, no one age 15 and younger can consent to ANY form of sexual activity.) If I were to have sex with a 15-year-old boy, I would surely go to jail.
Or, let's say, the 15-year-old boy were to rape me. Would he go to jail for the rape? And would I go to jail because I had sex with him? Would we jail mates? Hmmmmm....

Nah, I think it is crazy to think that you (or whomever!) would be punished for being raped by an underage person. It isn't as if you initiated the sex and it was non-consensual so you really couldn't be prosecuted.

If you were to have sex with a 15 year old boy where the law is this way...yes you would go to jail for sexual intereference with a minor.
If the 15 year old boy were to rape you, then he would be charged (I say charged because he is a minor and would likely not get prison time) ...you would not.

If there is evidence that the 15 year old boy raped you, he would go to jail or in his case, juvie. If there is no evidence that he actually raped you, then you would go to jail because you are over 18.

They don't put persons of opposite sex in the same cell, nor minors and adults.
Yes he would go to jail. Rape is rape.
The law you speak of previously refers to consensual sex. You even wrote out the word 'consent' yourself.
Think about your question next time and you won't have to lose 5 points.

That is why many states have what is referred to as "Romeo & Juliet exceptions". Basically it says consensual sex between minors that are within 2 years of age with respect to each one another is NOT considered statutory rape. As far as Alabama is concerned, this is just yet ANOTHER example of backwards thinking of the bible belt.

Most likely he would go to jail, and you would be charged with voluntary service of some sort. You could get your charges dropped very easily, especially if you say it was a rape - forceful sexual intention.
I'm scared as to why you would ask this...

Rape is Rape. If you were raped you would report it asap. Charges would be made against the rapist. If the rapist was 15 or under I would fight like h**l unless they had a gun. Sorry If you get raped you don't share a cell

I would think that he would be the one to be charged, especially if there is evidence of rape. I don't know if there is any precedent for this. I can imagine his defense attorney may try to paint you as the offender, because he is a minor, as a way to get his client off.
