I am pregnant by a married man. He lied and said that he was divorced. He told his wife and she has forgiven him. According to her, this is the fourth time in three years that he cheated. She has forgiven him each time. They have two children together. This is his tenth child! His income is about $60,000. Her income is about $80,000. I only make $30,000. Because he has so many children I'm doubtful if I will receive enough assistance to care for a child. Can her income be considered in the amount of child support I am awarded. I know that they do not have any accounts together because of his previous child support cases. Can someone please answer my questions???

Added information...He lived with me. Once I found everything out, the whole situation was too much for me. He then went back to her. She forgave him but gave him an ultimatum, which is no contact with me or my baby. She got my number out of his phone. She has called me about five times. She says that all contact has to be through her. She doesn't want him and I to talk. I figure if she can make all of the rules, then she can pay child support too. I made the baby with him, not her so she should stay out of it. Since she wants to put herself in the middle, she should pay too.

Including the wife's income in child support judgments varies by state. In this state, yes, the wife's income and assets are garnished by the state to pay for any children the husband might create. Totally unfair and another reason to drop the guy's sorry butt.

But let me get this straight -- you want to punish the wife by taking her money because her husband is not only a lech but can't get a vasectomy?

Wow, I can't believe you would even THINK of punishing her and the other kids by touching her income. Even if the state DID allow that, it's the most selfish thing I've heard in awhile on here.

You somehow know everyones income already. So if money was that important and on your mind, you should have thought of that before considering birthing a child from a married man with kids.

Depends on the state but mostly NO.
He will only be able to claim the children living in his household as dependents and only if he is the head of the household, which he is not. So you will be ok in court. Go for it, you will receive some support. Don't let him off the hook.
As for the wife, what a dumb dumb, it could be worse you could be in her shoes. Thank god for that.

You have a lot of nerve, she's not the one who you should be trying to burn. You choose to sleep with a man who you didn't give the time to check out if he was lying about his situation before getting pregnant. NO, her salary won't be considered in his discretion's, now you need to deal with yours. The law has a way for men to be accountable for their actions finally without the wives's having to suffer.

I think "WOW", what a situation. First of all, I think its between you and him not her and you. Just because he's married to her doesnt give you the right to take from her even if you could. Thats my opinion.

no she is not part in the pregnansie shame what a stupid woman to stay with sutch a sex maniak you should take him to court im sure you could work something out with his vety smart wife she does sound very supportif.

I'm not positive .... but I think if there married her income does count because of the marriage... kinda messed up thou because she didn't get you pregnant he did ...
