now then can i sue and how much can i sue in injuries i have incurred? meaning PAIN AND SUFFERING!

Did this activity by the govt employee cause damage to you financially, thus causing pain and suffering? Then I say sue the govt agency! The fact that you've never been married shows that you have a strong case.

Sure you can sue, but one of the four elements of any type of tort action is that you have to show damages. From my experience, lawsuits based solely on pain and suffering rarely fly. What was the real harm here? What personal injury or property damage did you suffer as a result? See, if it affected your tax return, you could file suit for reimbursement of any money you would have received from the IRS were it not for the error. You could also sue for inconvenience expenses -- meaning you could seek reimbursement for all the time and effort you spent getting that mess straightened out. But if you're claiming that you suffered emotional distress as a result of this and are looking to collect a big chunk of money, the judge is going to say "You need to learn to lighten up and stop wasting my time with this -- next case." Sorry to be so brutal/rude, but I have dealt with judges and what you're describing falls squarely under the definition of a frivolous lawsuit. Judges have no patience for that.
