They also do not pay you for a holiday unless you've been there 90 days. It's a regional trucking company in Long Island, NY.

It's an hourly position. I'll check with the labor board. I'm just suprised. I know some companies are exempt but I can't imagine on what basis they'd be exempt. It's just a regular local/regional freight company. This company has been around for awhile. I can't be the first person to question the policy.

I'm not sure about the OT being after 55 hours instead of 40, but the not paying for holidays until after 90 days is pretty standard.

I'd contact the state labor people-NY is prettly good about it. Normally, if you're a "non-exempt" ie hourly employee, OT starts at 40 hours. There are exceptions. Check your state dept. of Labor website, or if you are represented by a union, start with your shop steward.

i know that i do not live in Ny but i have called the labor board on my job as well. i work 40 hours an still the company considers me to be a part time employee messed up huh. well the labor board says they have that right and i can do any thing about it. so the answer in my opinion to your question is yes they can and no you can do anything about it

R u a Salaried Employee? Salaried Employees R considered exempt from overtime pay. But like u said, ur company doesn't want to pay u overtime, which is against the law. U should definitely report them ASAP!!!!!

nys law is any thing over 40 is over time holidays is up to the employer.i live in long island too so i know.i hope this helps u. if you can call the bord of laber on them.

Call the Dictatorship, they will make them pay. Tell them you a minority and you get "Double Time".

read the contract if they have one to determine OT coverage
