When I worked in a restaraunt as a cook.I was forced to work 7 days a week.12 straight hours with no break.
Told my work was poor.If I was such a bad worker
why did they keep me for three years instead of saying
if you can't handle it you will have to go do something else.
What about the 5 day work week rule.30 minute break
for 6 hours or more.I thought that is the law they have
let you have a break.One day I told them I refuse to work
7 days and I got fired.
A waitress's grandmother passed away and the manager
told her she could not have the day off for the funeral because they were short on help.She took it off anyway and
got fired.Was the manager being unfair?

Working in a restaurant is almost never fair. Hours and wages are long and low. Some of us are just "addicted" to this industry, and are willing to get no breaks, etc. If this isn't your chosen field of choice, it's better to work at Wal-mart, more of a "real" job.

I need a little more information. My last job was 14hours a day ,6 days a week. It had to be a little more then hours between you and the manager.If you had worked that many hours per week for 3 years without breaks or vacations the restaurant was in violation of labor laws. The law demands you post a notice of the wage and work week laws in a prominate place where employees can read it. Unless you are a salaried employee you are to be paid time and a half for over 40 hrs. If salaried you are to be prorated for more then 48 hrs.You are to have a break for every 4 hrs. worked & at least 20 minutes for either paid or unpaid lunch.As for the funeral it is sad but the manager was within his rights. My company was fined because I got hurt on the job & OCCA found I got injured because I worked 84 hours a week. They fined the company $ 10,000. I no longer work there because I am now disabled from the job.

Yes, the manager was being unfair. It is absolutely illegal what the manager is doing and you can go to the labour board and file a complaint. Someone needs to sue this manager or they'll just keep treating people like dirt. There are laws out there to protect employees from such harassment as you describe here.

The manager's attitude isn't illegal, it just means he's a jerk. However, there are state and federal laws that regulate breaks, work hours, and overtime, and it sounds like this restaurant is in violation of several of these. Contact you state's Dept of Labor, there should be a way to report these violations. Talk to people working there, others who have been fired - you have a valid reason for reporting them and possibly suing.

In my opinion the manager was being unfair. She should have been allowed to attend her grandmother's funeral. He has no compassion or empathy for his workers. He is abusing his authority and I think it would be better if he had amicable relationships with his staff.

that is illegal and both of you should be taking the company to court and find others who worked for the place and are upset to help fight the place . In the mean time you both should be getting workmens comp.
