I also missed a days work that I will not be paid for, had trouble eating for a few days and still worry about eating glass whenever anything gritty such as rock salt is in my food.

The resterant i was in was the hotel resterant that i was staying in for the week and it is a 5 star. My friend also had to miss a days work as noone from the hotel came with me to the hosipital and i do not speak spanish.

Of course you can always sue, but how much will it cost you to sue? And do your paperwork from the hospital basically back what you said about the glass meaning did they find any glass in your system, were there any traces of scratches or ruptures from the glass being swallowed? Did you ever make the restaurant aware of this? If you are sure you have all the prove you need, go for it, fine or not that should have never happened.

It sounds as if you were barefoot in the restaurant. If so, then you assume the risks. I think it's hard to sue long distance. Forget it and move on.

If you were fine, other than reimbursement for the food, how were you damaged?

Without damages, you have no basis for suit.
