Phones don't have GPS, but there are other techniques used that ate not so accurate. Most network operators provide location based services, but the owner of the phone has to opt in. For obvious reasons, you are not allowed to obtain the location of cell phones in general.

a gps is one way .
anyone with a phone can be located even without a gps but unless you are with the government you cant
