okay, i have this friend he currently owns a MS driver liscence but was driving under the influence in FL. his blood showed .28 and the legal amount in FL is .17. he ended up damaging private property this all happen around 2AM. My question is would he get jail time or probation. or will have to pay a fine or what.

It depends on if he was convicted before. First offense is usually 30 days in jail, a hefty fine and suspension of the driver's license. Community service might be required as well.

Other effects can include an instant jump in insurance rates, loss of commercial driver licenses, and manditory drug/alcohol abuse counciling.

Your friend was was more than THREE TIMES the legal limit in Florida, which is .08! He can very well end up with jail time, considering the the property damage and whether he has any prior DUIs in other states (the prosecutor will almost certainly have this information!) He had better hire an experienced Florida DUI attorney!

If this is a first-time DUI, he could be facing (most of these are mandatory):

Up to $1000 fine
Court costs
Up to a year in jail
Suspension of DL for up to 12 months
Mandatory 50 hours of community service
One year of probation
10 days of vehicle impoundment
DUI School (there is an additional cost for this)
Victims Awareness Class (there is an additional cost for this)
Ignition Interlock Device for 6 months
Alcohol and Drug Evaluation, which may result in court-ordered counseling or treatment.

well dear sad to say but i'm in New york and i had a DWI when i was 22 i'm unceartain of the laws in Fla, considering i have never been there but i paid 650$and did 100 hrs of community service and 30 days in jail,sorry if that didnt help doll have a great thanksgiving and holiday
