My fiance' has 2 children 18 and 21. She recently foud out she still owes arrears for the past 5 years on both children. The court put her in jail for 30 days last month for contempt, non payment. Her ex husband has sent me and her mother e-mails offerig a lump sum settlement and if we do't take it he will use her past to keep her in jail for as long as the law allows him to. If we take he says he will drop the issue forever, obviously hes just being money hungry. My question is can this be considered extortion and can he be charged as such?

First of all, she needs to pay the child support to stay out of jail.

Second, if he is asking for a higher amount (has too be considerable) than is due for child support, it could be considered extortion. Other factors need to be taken into consideration.

My best answer to all this is too talk to an attorney, keep the emails and try your best to decide if this woman is the person for you.

If she's on the hook for the full amount and he's willing to accept something less, what's the problem? She can either live up to her obligations, accept the deal, or pay the price.

What's this about "just being money hungry"? She didn't support her kids for five years and he had to pay the freight. How do you just find that out? "Oops, nobody ever told me I owe support!"

It's sad that someone who dodged five years of support obligations is looking for a way to shaft a custodial parent who made an offer to settle for less than the full amount due.

Sorry, but your fiance can't JUST FIND OUT she didn't pay child support. She knew all along that she didn't pay what she owed if it was a large amount. I say bring the letter to her attorney and see what can be done. She owes the money no mater what, but the way to get it has to be done legally! This man can not tell her how to pay it, only a judge can.

I think I would find another fiance,irresponsible and doesnt want to pay her child support.If men are expected to so should women.And if he has proof of her doing something illegal,I support the exhusband,thank god her kids are grown now and I would have second thoughts about the type of person she really is guy.Seriously.

first of all you should beat the hell out of her ex and f#ck what he says do what you think is right for the family

It is illegal. You would lose in court
