Whether a marriage fails or not a engagment ring is given as a contract for marriage. As long as the couple marry the woman has legal rights to the ring, unless a pre nup was signed stating the ring goes back to the owner upon divorce. This can happen in cases of family heirloom rings. If this not the case the woman has kept her contract by marrying and therefore regardless of divorce has ownership to it. She can do with as she pleases.

Wedding rings is usually a gift from groom to bride and gifts are personal property unless it is agreed before the marriage otherwise for example bride receives from groom mother ring which is passed for few generation from mother in law to bride. Same rule applies to the engagement ring.

what they may do with it i do not know
the only time the diamond is returned is for an engagement not ending in marriage ..in that case the ring should be returned to the giver
that is the rind etiquette as far as i know it

My mom kept her wedding ring when she divorced my dad. Some years later, she gave it to me, and I still have it. I also kept my wedding ring when I divorced my husband.

I kept the ring along with several other peices and our daughters fiance had them reset into a lovely ring for her. they just celebrated 1st anniversary in Oct.

It was a gift given to her by you. She keeps it.
My hope is that my ex-wife will make something nice out of it for my daughter. However if she doesn't it is hers to keep!
