Generally, infidelity is grounds for reducing, if not eliminating, alimony. You have to be able (and willing) to prove it.

If you file first and prove that she was into wrong doing then chances are that the court will allow alimony for a certain period of time, then she's on her own. No court is going to allow you to just divorce her clean and free if she hasn't worked. And, depending to where you live, she may be entitled to half of your retirement benefits. To complicate matters further, you have a minor child - so you may be on the hook for alimony AND child support.
I suggest you just think of it as a marriage of convenience for the next 7 years. When the kid is 18, give her the shove. Either way, I suggest you consult a good divorce attorney.

I know a lot of divorced people and none are paying or receiving alimony. Do you have young children at home? Why doesn't your wife work? I'm sure the judge will want to know this information. I'm sure some men do pay alimony but it doesn't seem to be as common as it once was.

Depending on how long you were married and also the fact that your soon to be ex-wife was dependent on you working. There is a very good chance in the eyes of the court you will be paying alimony. But if your ex does not fight for it you are in the home stretch. Also you might want to think about that if you have a 401K she will get half of that too! But she might not be that smart to realize that either. GOOD LUCK!!!!!

Depends on the circumstance of the cheating? Can you prove it? You will most likely have to pay support unless you get primary custody of the 11 yr. old,, but alimony isn't an issue if you can prove she cheated. (unless you have cheated also) If that is the case your screwed.

usually, taking under consideration that regulations do selection quite from State to State. in the U.S., alimony isn't paid anymore. newborn help, on the different hand, is often paid by utilising the non-custodial determine. besides, if the matrimonial house is owned by utilising the divorcing couple, whoever gets custody of the toddlers gets to stay in the living house .. the Courts experience that the toddlers are recent technique adequate loss and alter, and the Courts do not elect to confirm the toddlers ought to bypass away their living house. not until they're older. besides the undeniable fact that, that would not consistently recommend that the living house call is transferred over to the custodial determine. Alimony is now and lower back ruled by utilising the choose in circumstances the place the girl needs some short-term alimony on a similar time as she gets activity training .. so she will then bypass out and artwork and help herself and not prefer alimony. Or in the case the place that's a protracted-term marriage and the spouse has exchange into disabled and could prefer some economic the help of the husband. Or if she is in her 50's/60's and has by no skill worked and has no activity skills. you notice .. a protracted time lower back, females have been meant to be dealt with by utilising men, so as that they stayed and took care of the living house on a similar time as the boys worked (females weren't allowed to do the stable jobs, besides). females have been seen as "vast toddlers" who needed men to look after them. yet now, with equality, females are in charge to help themselves. If the marriage ends, the two events are seen adults and grown-up and in a position to help themselves. cheating is not a controversy. In ALL States, divorce is not any-fault. meaning the Courts not care if somebody "wronged" yet another. they simply elect to confirm that the valuables interior reason divided and that the toddlers are going to be supplied for. belongings branch applies to each thing that has been won by utilising the two/the two events for the time of the marriage, no rely whose call it ought to be in. And no rely who worked or who made how plenty $$$. the sole exception to the branch rights is an inheritance, which isn't concern to branch while there's a divorce. And besides, legally cheating is observed as "adultery" .. sexual intercourse with somebody not your companion. you may't "cheat" by utilising text fabric. Your chum needs to talk to a criminal expert in his own city.
