If a baby isn't born yet and not due until January can you claim them on your income taxes for this year? Or do you wait until next year? I have been told both, but not sure whats true. Please only answer if you really know the truth.

HI, You can claim a baby if they are born one minute before midnight on the last day of December, but you have to wait until you do next year's taxes if the baby is born on January 1st. I had a baby on the 29th of December which was nice, because we were able to claim the baby for the whole year.

Must be born to claim deduction.

However, you can claim certain uninsured medical expenses for an unborn child on your 1040A, subject to a floor expense level and ceiling deduction amount. Usually it's a pretty difficult tax feature to take advantage of (depending on your income), but it's worthwhile noting that it exists.
