I don't think it's fair that he doesn't want to take responsibility for his child. I can't make him be a father, but I think he should have to pay me child support. I am in the process of going through child supt services now. I just want to know if he asked to be relinquished, will it be just that easy?

The father signs away all rights to the child and has no claim what so ever on the child - no visits, no imput in the child's life and no responsibility to the child at all. It is up to him to decide on relinquishing his rights to your child ... asking is easy but living with it is not...

Termination of Parental Rights

Defined

A termination of parental rights means that the person who was the natural parent of a child no longer has any rights or responsibilities to that child.

Rights:

Rights regarding a child include the right to decide what kind of education, health care, religion, morals and values the child should have. Custody rights and visitation rights are also associated with children.

Responsibilities:

Responsibilities include the duty to provide food, clothing and shelter for the child, provide all necessary child support, daycare, etc.

A parent whose rights have been terminated has the same rights and responsibilities toward that child as a complete stranger. Such a parent is not responsible for any support, nor is that parent allowed to have any input or influence over the education, teaching and upbringing of that child. In fact, a parent whose parental rights have been terminated does not even have the right to see or contact the child.

I believe a man can sign away his rights as a father which is sad. Join the club, hon, there are so many men out there that don't support their children. My ex is going to court for child support next week and would probably sign away his rights if if wasn't for his mother wanting to spend time with the children. Is he a good father other than the fact that he sounds like a dead beat? Maybe the children are better off without his influence. Even if he does have to pay child support, sometimes it takes forever to get it unless his check is garnished and alot of guys out here don't even have a "real job" to do this with.

No. He wishes. If he is the proven father he will still be responsible for child support until the child is at least 18, longer in some cases if the child goes to college. Go through the legal system, get your due, and then raise your child. If he does not want to participate further in the child's life, that will be his loss, not theirs.

Relax. Take a deep breath. You don't have a problem. Legally, parenting comes in two parts: rights and duties. You can give up your rights any time you wish. That doesn't affect your duties. Period.
He has a duty to support the child. Through the courts, you can force him to do so. Whether he reliquishes his "rights" or not makes no difference. He still has a legal duty of support. There is nothing; absolutely nothing he can do on his own to end that duty.

A termination of parental rights has to be approved by a judge. Judges do not allow parents to terminate their rights merely to get out of paying child support.

i tink when a guy gives up his rights as a dad he still has to pay child support. all he is saying is that you cant ocme to him and make him be a father. but im not 100% sure. i just no my ex's dad payed child support but he has no idea who he is and his mom only told him where he lives. she got pregnant at 14 and he was 19 so im pretty sure he gave up his rights but like i said still paid for it.

Get annoying evidence. this is somewhat complicated to terminate parental rights. even whilst the discern would not have a job and drinks plenty. He may even combat along with his female buddies all day long and in basic terms feed your son Macaroni & Cheese all day long. this is somewhat complicated to totally terminate parental rights.

damn, I'd take the kid and run. If he doesn't want to be there, you should thank your lucky stars that the bastard isn't going to have an influence on your son!
I am trying to get my ex to give up his rights because he is a loser. You are really lucky.

maybe, if you dont bust his b=lls. just get the money. you cant force him to be with his child. he will regret later in life.
