So my question is, can I get a new plan with cingular without having to pay a deposit or having to get into a 2 yr. contract since I don't need to get a phone from them?

You can set it up as a Go Phone with COAM(customer owned and maintained) equipment. All that you need to do is call telesales(or go into a store) tell them that you want to start service on a Go Phone account and that you already have a phone. They will send (or give) you a SIM card and you will need to call in (or it will be done in the store) to set up the service completely.

If I understand you correctly, you have a Cingular phone and want to sign up with Cingular but not sign a contract. If this is correct, the simple answer is YES. It’s called a “no contract Option” on a post paid account. You would have to go to a corporate Cingular store and ask for a COAM, or customer owned and maintained equipment option. Lets say you wanted to get the 39.99 plan with 450 minutes, roll over and 5000 N&W with m2m. The difference without signing a contract would be you would NOT get the mobile to mobile minutes, That’s a promotional feature for signing a contract. Not signing a contract means you are not eligible for promotional features. As to a deposit, you still might have to pay a deposit depending on your credit. Other option is pre-pay Go Phone but the best bet is the post pay no contract

Yes you can, I just did a few months ago. I did go down to a cheaper plan because I wasnt using all the minutes I was paying for and my rollover minutes were expireing. I paid nothing extra and didnt have to start a new contract. The only time I think you have to start a new contract is if you buy a new phone and want it at the new contract price. The cheaper price. If not you pay regular price for a new phone and dont ahve to start a new contract.

I have been with Cingular/AT&T for six years now and you have to have a new contract/new phone. I upgraded my phone six months ago and now have to get a new one along with a new contract.

I believe you can and they have those go plans too. They offer the new phones for free so that you can get into a contract, but if you already have a phone, there's no need for a 2yr contract
