becasue the legislative branch of the govt made it a law because the people of the nation said they don't want people driving and drinking at the same time. The excutive(police) fine you for breaking it. this is how america works. the "game" may suck, but its the only one we have to play.

Why would that be necessary?

If you can't wait until you get home or to the nearest bar - maybe you should consider that maybe you have a drinking problem?
Two beers and drive MAY be legal, but is it an intelligent decision?
.08 around these parts and you'll be bumming rides and hitch hiking for a while.

I strongly suspect that, should you be involved in an accident, the last thing you need to shore up your defense is an open beer in the vehicle.

Hmmm, you make a very good point. The only thing that I can come up with thats even close to logical is that it would encourage driving under the influence... but thats a pretty weak case!

Probably because they suspect you might have had more before that. Or maybe because actually drinking it while driving is a distraction.
