MY Co-workers and all took one. what will happen if the innocent one failed and the criminal passes? Can a polygraph be used against you? What would you do if you owned this business? would you fire the one who failed?

It's hard to fool a polygraph. Generally, the longer the questioning lasts, the more reliable the polygraph is. If you did nothing wrong you shouldn't be worried. If I were the owner of a business and had reason to submit my employees to a polygraph, and one failed then yes I would probably fire that person but it would depend on what the "crime" was and if it had anything to do with the workplace. If the employee still protested his/her innocence I would offer to let him/her take the test again.

It can't be used in most jurisdictions - it's not considered reliable. There are a few cases where it can be introduced in court. But, that doesn't stop an employer using the results to dismiss an employee. The employee may have a wrongful termination suit against the employer though, if that's the only reason for termination.
