i wanted to know if the child could be a certain age and if they decide they wanted to live with there dad and not there mom. could they go to court at a certain age and the dad will get custody and what does it take

I live in Indiana and have dealt with this recently. When there is a custody dispute, the judge may talk to the child regardless of age to get a feel of how the child feels. If the child is 12 years old or older, they can say with whom they prefer to live with. However, it is ultimately up to the judge. As long as the parent the child chooses is able to care for and provide for the child, the judge usually goes with the child's choice.

A child over the age of 6 in just about all state courts has the ability to voice to the judge a preference of living arrangments. But the choice still comes down to the judge, who will try to consider the wishes of the child, but must first consider the childs well being.

i live in kentucky and the way they do it here is if the child is atleast six the court with ask him/her who they like to live with and who takes care of them..at about the ages 11-14 the court with give the child more choice to whom they'll live with but all in all it goes with whats best for the childs well-being
