If you knew and did not inform the buyers then you could be sued...if you did inform them of the problem and they still choose to by...then you are fine....its their problem know....

If you are selling it for what it's worth and not trying to give it as a gift, then yes you can do it. You can do it even if you are selling for less than it's worth or doing it as a gift, but that can trigger some tax liabilities that you should discuss with an accountant.

Most states have homeowner disclosure laws. You can be sued for fraud and misrepresentation. Not only can you be sued for the cost of the repairs, but also for punitive damages. Good Luck!
