In most states you would register the business with the Secretary of State. This means paying a fee, usually small. In smoe states the same name can be used by a corporation and by an LLC. In those states you would have to register both types of business.

If it is a Sole Prop you can go down to your county office and get a Ficticious Name Statement and that will register your name within the county.
