it depends if you had the intent to kill or not.

If you had the intent to kill, yes, you could be charged with murder.

Yes, you neglected to take care of him/her.

Just because its an 'enemy' doesn't mean you shouldn't be taking care of him by giving him a drink or something to help him stop choking. Plus you could of done CPR. You'll probably be sent to jail as man slaughter.

Anyways, I think it would be hard to prove you purposefully withheld a beverage, without a witness, so plan your lunches accordingly

If they can prove that you INTENDED[1] to kill him in such a manner and you SUCCEEDED[2] in killing him, then -- YES, it is a full fledged 1st degree murder.
Realistically it will be kind of hard to prove that you intended to kill a man in such a fashion.
