It depends, whose name is the car in, and is "he" a friend, boyfriend. There are many factors in play here. Call the local police and get some advise.

It all depends on who's name the car is in. If you have it in both your names you should contact an lawyer for legal assistance.

If the car is in YOUR name only, call the police and report it stolen. You can even report a car stolen even if a spouse has taken it and their name is not on it.

If he holds the title, the answer is no. If you broke any terms of a contract/agreement with him, he can keep the car and if you take it, he can call the police and have it reported stolen. If the car is in your name, then you can. Your question is vague as to who 'he' is and why 'he' has it. Hope it helps.
