Your query is very vague you have not given details of your marriage. But what I can make out you are Hindu by religion an married a Hindu girl according to Hindu marriage ceremony. According to Hindu Marriage Act,1955 you cannot move the court for marriage before 3 years of such a marriage ( u/s 14 of the Act). The reasons for divorce are given in sec 13 of the Act and if you fulfil any of the reason you can proceed. The petition for divorce can be moved by you in the family court usually its the District court. The paper work regarding any divorce proceeding starts only if your case is fit enough for it. Best course for you is to get the bare Act from the market or down load from the web side study it. Sorry there is no mutual divorce under the Hindu Marriage Act,1955 this privilege is only marriages registered or preformed under Special Marriage Act,1955.

There is no such thing as some sort of depression disorder that happens to newly weds. Your American. You moved to a new country. You married a man of a whole different race and culture. Sounds to me like you gave up everything to be with this man. You gave it all up and on some level you know that you did the wrong thing. And your 20. Are you insane?!? Your 20, and married to a muslim man, that I can bet, he will never let you go back to the States. Again, your 20. What were you thinking? Being in love is one thing, but it does not mean you have to get married to prove that. I can't get my head around this. Of course your depressed. There is no 20 year old that I know whom is married and living in a whole different world. Let alone India. Maybe you should have done this when you were something like 27. You would of been a lot, a lot more ready for it. Wow, all I have to say is wow. I was 22 when I married the first time, and I left when I was 24. All I can say is good luck. In all aspects. Pl approach the family courts set up for the purpose in India. If any problem exists between the couple, which definitely leads to divorce, then only the family courts take a decision on the divorce.

Only if the marriage was registered in registrar's office, the divorce has to be given through a lawyer's notice and then proceed according to the law. (lawyers will know exactly). Otherwise, if the marriage was not registered, just call a few witnesses from both sides and make both the parties to accept the divorce.
