my ex-wife remove my son from the state without notifying the courts first son has a geographical restriction

Kidnapping is the crime committed by a person when taking the custody of a person without proper authority. Thus, your ex-wife is guiltyn of this crime if your child was taken without the order of the court.

if indeed in your divorce it is mentioned that your wife may not leave the state prior to acceptance from you ? yes you may file a complain,
kidnapping is not quite the case here ,but i cannot say that for sure ? ,,since you know of her whereabouts , she may be charged with disobeying her court order ..and you need to get in touch with your attorney ? or inform the court about it .#family court # from your state should have a link on the internet ? look for the one nearest you .

It is unlikely you will be able to proceed with a charge of kidnapping, but rather one of violating a court order thereby placing herself in contempt of court. Parental Abduction is a long shot.

Yes, you know you can. But do you really want to do it to your sons mother, remember his child and he needs both parents and both of you must make piece for your sons sake. If you love for son, both of you will settle down. Just speak to her, give her a warning if you have to. Always remember your son, it’s about him and not about you two that are enemies.
