My husband and I are getting a divorce. I have a daughter with him. All in all he isnt a good person unfortionatly I cant prove this is in court. He wants to fight for primary custody and I am afraid he will get are there other types of custody where we can split it or something? Any advice helps thanks.

unless you are super screwed up he will not get sole custody. You can share custody (joint legal custody).

You need to start researching your state laws now. This is yours and your child's future. Take control of this situation now.

There is no sense in trying to prove he is a bad person. He is the father and has rights to his daughter. Saying bad things about him just makes you look bad to the judge. Use the laws and look up previous cases that you can compare to what your going through as a reference.

There are lots of different custody rulings. Sometimes it is spit 50/50 and then it can be broken down almost any kind of way couples want. Don't worry too much, in this day and age you would have to be a total crack head for a court not to award custody of children to their mother. Most marriages end in divorce and the parents share custody. This will all work out, you will see. Just remember that regardless of what went down with your husband, always put the needs and the welfare of your daughter first... even if that means that your husband is awarded primary custody... Well it's funny how the person we Married because we Loved Him/Her is somehow the worst person ever when we depart our ways.That makes you look as though you have no control on the saturation, So do not say that in Court. Primary Custody is who ever has the child with them when the person leaves without the child ,But you can take your child back any time you want as long as the other Parent is not around. Go to Court and fight for Custody.May the best for the child come about.

I suggest you change your name - or avatar- in case it comes up in court-so it can't be used against you- most of the time couples get joint custody w physical custody to the mom- so he pays child support and if you split it(the custody) - you may not get child support- visitation may be every other weekend and 1 time a week for 3 hours. That is what we do- D

Primary might be the same as sole custody to one parent with visitation rights the other; then there's sole custody with no visitation rights; or joint custody where you share equally. That one's sometimes the hardest because the kids may have to divide their week between two homes. Ask yourself what is the best situation for your daughter. If he really is bad and he's going to play hardball, invest in a lawyer.

I'm sure he's not that bad, if you love your children you won't deprive them of their father. If he wants some kind of custody with them he must love and care for them. Don't take them away from each other!

I am sorry to hear about your divorce, the only advice I can give you is to ask Legal aid, or call up legal centres, some places should free over the phone advice...sorry i was not much help

WELL unless he is an abusive criminal. OR HAS molested your daughter he has rights. JOINT custody is what you may get.
