If one person is SOBER, and they have sex with a DRUNK person, it is considered rape. What about when TWO DRUNK people have sex with each other? is that rape or is it just stupid?

I think as long as, at the time of the encounter it was consenting. Than it's not rape, it's just a bad mistake. I know, I've gotten drunk and did a fat chick and regretted it. It wasn't rape though, just bad decision making.

Not rape automaticly. But if you have just met this person, having sex with them the 1st time while they are intoxicated is a bad idea. They may not really want to, wake up and oppssss.
If you have been with someone for awhile and there is no issue like that, in Texas it's legal.
As far as two intoxicated people....it happens in every bar in every city in eah state every weekend...some might say every night.
