how to get a quick divorce? irreconsiable differences. married for 1 year. together for 3 years. tried everything.

Good you have mentioned your marriage has been solemnised under Hindu Marriage Act,1955. 3 months separation does not qualify you to obtain even Dercee of Judicial Separation (u/s 10 of the Act )which say separation should be not less then 2 years leave aside divorce (u/s 13 of the Act ). More so you can move the court for divorce only after 3 years of such marriage (U/s 14 of the Act). Here i want to add for your information there is no divorce by mutual consent under Hindu Marriage Act , such provision is only under Special Marriage Act,1954 but you marriage is not registered under this Act so you cannot get its benefit.My suggestion COMPROMISE with your spouse.

You can move to court and file a divorce suit. Obviously you have to give alimony for that. The most important part is that whatever happens, you have to accept that under normal circumstances the mother will get the right to keep the child. You have to see that you get the opportunity to see your child every day for a considerable period of time.

If it is really not possible to reconcile and the separation is inevitable, the best way to do it quickly is:

Mutually agree for divorce; hire a good lawyer and file an application for separation.

Caution: No compensation issues, custody issues and mud slinging or personal fights to be involved.

If its mutual then you both can hire one lawyer and he will sit with you and chalk out the settlement and then file it in the court.Usually you have to be living seperately for atleast one year. Once filed in the court the judge will decide how much you need to wait for the final motion .best is to talk to a lawyer.

IS IT MUTUAL? WHERE IS THE DIFFERENCE? WHY DO U WANT TO SEPERATE? DID U PLAN FOR THE BABY'S FUTURE AFTER DIVORCE? DONOT SPOIL THE KID'S FUTURE.

APPROACH THE ADVOCATE, STAY FOR REQUIRED TIME SEPERATELY. ARRANGE FOR THE FIANNCIAL FUNDS, IT COURT DIRECTS.
THINK TWICE BEFORE TAKING ACTION.
