I am going through a custody battle and my ex lives with his girldriend who is legally married. Someone told me it is a Va law that two people can not live together is they are not married.

It was when I lived there, I lived there until 1995. It was an old law left on the books. Any sex other then conventional sex is also illegal, that was left so they could throw the book at a rapist. Common law marriage in Va. is a shorter time then other states, also if you tell people in a public place that you are married, like court or the news you may be considered married. If you go to a local library they can direct you to law books that have old laws that are still on the books. Make sure the Guardian ad litem likes you.
Be very careful with the custody thing. Virginia courts are proud to hand children over to fathers without any regard to the child's welfare.

It may be a state law but you must likely will not get fined and/or punished for it. But there is no common law marriage. And the courts will almost always favor married couples. ^_^

Various states and counties have tried to enforce laws like this. Most are currently undergoing legal challenges as unconstitutional.
