i hired an attorney, i'm filing chapter 7. the reatiner was 1,000.00 i have paid a payment of 700.00 i asked him how my case was going he said he has done nothing because i owe him 300.00 i want to my money back so i can find someone that will work with me while i get the rest of the money. i got 5 letters from dmv for court because he has done anything. most of my debt is from dmv..........

If you hired an attorney for the purpose of filing a Chapter 7 bankruptcy, you and he contracted, (according to what you have told us) for a fee of $1,000. Now, according to the modern bankruptcy law in the US, you are required to have signed a contract. This means, you agreed to certain terms.

Look for that contract, and read it carefully. What services is he/she to perform for that $1,000?

I don't know where you are in the US, but $1,000 if a relatively inexpensive charge for a chapter 7. In my area, $2,000 is more common, including the filing fees and other costs.

I would first ask him/her for a refund and then consider retaining other counsel and then worry about DMV.

While we are there: You indicated you have 5 or 6 letters from The DMV for court. Generally, a summons from the DMV invokes a traffic and/or a criminal matter, which is NOT adressed in bankruptcy.

You need to consult with an attorney licensed in your state, perferably one who has a general practice.. so he/she can advisse on bankruptcy and/or traffic matters. for a referral, call your local or state bar association.

He should have told you up front that he wanted all the money before he files it, most do it on their computers anyway. You should have a copy of where you contracted him and his fees in writing. He does not have to take payments and he can decide to hold the info until paid in full. Do not hire another attorney unless this one is no good, he will file when he is paid in full I guess.

I really don't think you are going to be able to file banko on your tickets, you cant file for back taxes, or student loans. You just blew 700 dollars. for a banko that would have been dismissed. that is you would still owe the money and paid an atty 1k to hear a judge say it you.

i have no idea but how can you accumulate that much money from the Department of Motor Vehicles?
