A person suffering from schizophrenia cannot sue another legally. He must be represented by a representative, parent or guardian.

That would be besta answered by your lawyer, but if they can prove that the sue was made when this person was in medication and in perfect knowledge of actions could be possible

My humble understanding is that people with mental health issues have the same legal rights as anyone else.
