My kids are 14 and 15 years old. They don't want to spend time with their father. The agreement we had specified certain holidays as well as every other weekend. This agreement was made when the kids were in grade school. The agreement also states that my ex is to pay child suppport on the 1st and the fifteenth of every month. He is always late. Do my kids have any legal rights in this matter? Hasn't my ex already broken the agreement by never paying the child support as agreed?

The children get to decide when they turn 18. Until then the court decides. If there is a visitation order in place then the kids have to go or you’re in contempt of court. You can certainly go back to court and attempt to have the visitation ordered modified. However, courts do not like to deny a parent the right to maintain a relationship with their children, and they will not do so without a VERY compelling reason. That reason would have to be a whole lot better than 'the kids just don't want to go'. It would have to be something along the lines of the parent being unfit in some manner. Even in those cases, the parent generally receives supervised visitation.

As far as your other question, child support and visitation are two entirely different issues. The fact that Dad is late on his child support in no way means that he isn’t entitled to visitation.

I wish I knew the answer to this one. I live in Md. 2 kids 11 & 9. Ex hasnt paid support since January. Visitation is xmas, easter, and 1/2 summer. If you get a decent answer please let me know. Because I feel like my ex has broken our agreement too and its not fair that these guys get to call any of the shots, especially if our kids are old enough to think for themselves what they want to do. keep in touch. jenkins_nichole@yahoo.com

i think you should get the children to talk to thier dad about the way they feel i just hope you are not poisioning thier minds against thier dad that will always come back to bite you in the butt.
