my other half is trying to start her own business. she was cleaning and painting house that is run by century 21(they manage the rentals. Anyhow, she got aline of credit from ace hardware, and she wrote the managers name down as a reference. against the privacy act, ace called and told him we owe them money. is this legal? He is going to give us half and ace the rest?

No this is not legal! You get your wages and then YOU pay your bills. My company does not pay my bills for me!

Maybe. Did your wife sign a contract to do the work, or was she employed directly by Century 21? If she was employed directly, then she is an "employee" and is covered by the Fair Labor Standards Act, if not, then she is an independent contractor, and is out of luck.

Since she is not covered under the FLSA, I believe that the manager has not done anything illegal.

You should file a Complaint with your State Labor Commission/Department of Labor, which enforces the law relating to overtime pay and minimum wage, as well as employment agreements for regular wages, commissions, piece rates and other types of salaries.
