If the child still lives at home, is 18, has a job and does not go to college, is the non custodial parent still required to pay child support?? Even if the child is employed and is just living at home smoking pot and playing in a band?????

Forgetting the sentiments of parents worldwide, the New York State Domestic Relations law says until emancipated, or age 21, except if the child is still enrolled in college, in which case a family or Supreme court judge may order continuation to age 22.

Emancipation under the law is not likely when a child is living at home, except in certain defined circumstances.

Also, you should be aware that a settlement agreement in a divorce may alter the default provisions of the Domestic Relations Law.

At 18 he is an adult kick his *** out an you need to put a stop to the dope it is your house if the police come in you will go to jail tooat 18 the support stops

I believe 18...like everywhere else...The reason is by definition the kid is no longer a child.
