There are so many accidents that involve drivers who .....

- are overly tired.

- are older and not as quick as they used to be.

- just had a fight with a significant other.

- are taking certain prescription medications.

If I drink 3 beers and drive, and you havn't slept in 3 days, why do I face such stiff judgement, when you walk free?

It's not the reaction times -- it's the crime itself you're punished for.

Driving while intoxicated is a special case because there are special laws regulating alcholol and other intoxicant. But while it's easy to test for drug/alcohol use in an objective blood test, it's almost impossible to test for emotional or situational impairments.

So, driving while intoxicated can be punished by itself, separately, because there can be objective standards. But anything else can only be punished based on the objective results.

Because you would be the easiest of the 2 to PROVE in a court of law! :o)

American are held responsible in many states it is illegal to talk to the phone while driving.
plus have you ever heard of a wrongful death suit? if you are not paying attention and crash and kill some one you can be sued by the family of the dead.

they are, someone who is found at fault for an accident gets it reported tot heir insurance and possible criminal charges depending on the situation
