no no, it's not me.

someone i heard of, her boyfriend goes to jail for drugs. police finds stuff in the babys mother house but she defintely has nothing to do with it.

can they take the baby away under california law.

any links i can look into.

It's according if a complaint is raised with the state child unit whatever that is in California. If they fel the child is endangered due to living conditions aor company she keeps they may do so at will.
It's also according if they send the right or wrong person out to investigate. Some of these people are really over worked, and trying their Best, but hidden among them are really *** es who would like nothing better than to cause trouble..
Most case workers are so over cased they bend backwards to help and try to do what is best for the children.
If they do make trouble for her a lawyer is her only recourse.

I don't think she will be in for trouble if they arrested him alone, but the best thing she can do is get a restraining order to keep him out of her home. This will show she wants no involvement with a druggie. Unless she does that she is as guilty as he is and should go to jail with him.
If she continues a relationship; with him he Will eventually get her jail time and the loss of her children. I t recently happened here to a woman WHO was divorced. She let her boyfriend have the run of her home and ended up losing her children plus jail time for cooperating with him .

My answer would have to be yes, they can take the baby away, so my advice is to get the drugs out of the house asap w/out getting caught. Good Luck, to ur friend! : )

As long as the baby is out of the womb they will take it.
Get a lawyer.
