Sure can. Get a lawyer, file for divorce, cite reason as 'abandonment', they put a notice in the paper that you are seeking a divorce, and if the spouse (no matter where they are) does not show up to contest after a short given timeframe you are granted your divorce.

You are already leagally seperated according to the law and 12 years is a long time. What I think you should do is go to your lawyer and tell them the situation then file a divorce it should be granted and you should be free but there are always complications when you have to go to court. Yes. You can file an abandonment divorce. Notice will be run in the newspaper for 3 weeks at the last place you have known him to reside.

Hi,
I think it depends on what state you live in. I live in a state where you can declare a person legally dead after a certain amount of years.
I had an Aunt that couldn't find her husband for a very long time and she had to go through alot just to try to get a divorce in order to get married again.
She even had to put an add in the newspaper to look for him and the add had to run for a certain amout of time.
After that, she had to see someone about declaring him legally dead and had to wait again for a certain amout of time.
Well needless to say, it is a long drawn out process in my state.

Though it is possible to file divorce papers on your own I would go see a lawyer. Each state's laws are different regarding this.

Well if you have been single for that long, chances are he is not coming back. But if you are male as well, there are not many states that have given legal status to marriage or civil unions so my thought is you are single already.
