I live in Junction and my husband and I as well as my sister were all pulled over and they found something that is used to smoke meth with in my sisters lap. Now they are charging my husband with it and trying to give him 2-5 years.

It all depends on how they found the adderall on you, and how much of it you had in your possession. If theres any way possible to deny that you had the adderall then by all means deny deny deny and plead innocent...especially if you can get a real kickass lawyer. On the other hand, not many people can afford expensive lawyers, so if you think theres no way to deny it, you should plead "no lo contendre" (which is 'no contest') because although you'll still be found guilty, it's not actually confessing to the crime, it's simply not contesting the fact that you supposedly had the drug/controlled substance on your person or what-have-you. I assume your husband was driving and therefore had control of the car and everything in it. They will charge your sister presumably because it was hers and in her lap. They will charge your husband because he was in control of the situation and at least an accessory to the possession charge. You could also be charge as an accessory depending on how you play it. As a defense attorney, I would try to point out that you and your husband did not know anything about this paraphenalia and are therefore not responsible for what the adult sister was doing. Chances are the D.A. will settle for a misdemeanor accessory of possession of drug implements. I would try to go for dismissal. You will need to disavow any knowledge of what your sister was doing and be willing to let her take the entire rap. You also need to know exactly what the law says that they are charging him with. Some laws are so tightly worded that there is no room to wiggle out of them. Others have lots of wiggle room. Find out what the exact wording is and then go over it with a criminal defense attorney in your area.
If you guys knew about what was in your sisters lap, then you will probably need to plea bargain out to a lesser offence.

Your husband would have to be aware of the posession of the the thing in order to be scentenced, but with it in your sisters lap, thts pretty tough. Your husband was driving the car at the time, so he is fully responsible. So unless you can convince someone tht ur husband was unaware of the thing, ur screwed

In general, if it's in your car, you are responsible. However, since it was in her immediate physical possession, they should be targeting your sister.

Also, did they test it for illegal drugs? Some smoking devices could be used for tobacco. Can they prove it was meth and not tobacco?

happend to me, with weed. i got arrested with my friend, i had the pipe in my hand, but we both got charged with possession.

maybe you could fight it. but not if you hire a public pretender.
the thing about law is that if you have enough money you can prove almost anything
