Does anyone know that when you have a court ordered child support to have it taken from your paycheck, (the child support is taken out weekly btw) you work in one state, but pay support in another, is it a federal law or do you go by state law on when to pay the support by? Because my husband's work has been withholding money but not sending it right away, when this went into effect they took out every week for a month and then sent the months for the next months payment, which caused him to miss an entire month. Is there anything we can do, the state the money is suppose to go to says they should have sent it for that month, and the payroll lady says she doesn't have to send it weekly. Thats not how the state we live in now does it. Who should we contact for help. Can anyone help us??

Your state notifies the other state who files a "Foreign judgement" If their state law doesn't make the employer send the money weekly you are out of luck. If it does then you need to have the other state send a compliance order to the workplace. Be careful tho, cause too much of a stink and he will lose his job (Have seen it over 10 times this year alone)

Court ordered child support is just that...no one can just send things willy nilly. If the court order is weekly then the payroll person cannot take it upon themselves to change it. Make sure the order reads that they support has to be mailed each week, not just taken out each week. Get the local authorities involved if you have to.
I'd first call and remind them that they are violating a court order and that if it doesn't stop you will be forced to contact the local DA's office for assistance.
Only give them ONE chance to make this right. Don't play nice, if you do they will continue to take advantage.
One other thing is to have the office in charge of collecting child support in your area to set you up with an escrow account that is monitored. If the money doesn't come in a red flag goes up and things get rolling without you having to do the footwork.

The child support clearinghouses cut the checks monthly. That's the way it is done. He did not miss a month, the money is backlogged in the clearinghouse.

It is a really bad system, and gets messed up a lot, but it is all we have.

I think it is under the state jurisdiction (since my sister was in the same circumstance as you). It is complicated when you live in different states. But your best source would be to talk with a lawyer.
