My 8 y/o son was abandoned by his mother and now lives with me .. after enrolling him in school today I realized that nothing was done in court for this change so I am still on the hook for child support. How do I go about getting these payments to stop since i have him living with me now?

It depends on the state. You'll have to find out your state's guidelines for such matters, but in Florida you have to file a motion with the Clerk of Court (I think) and get a hearing date. Call the agency responsible for collecting the Child Support and they should be able to tell you what to do next. You shouldn't need a lawyer.

The only way to do this is back in court. Of course you can do this without a lawyer if you are worried about having the money for that. You need to go into court, showing that he is living with you and that you have physical residence and therefore should not be paying child support. In fact and you can request this, she should be paying you now. Abandoned or not, it is her child, and she has to help support him.

Contact a lawyer and file for full custody since you have the child. Keep accurate documentation on everything you do while having the child. This will help you and keep her from trying to dispute you having the child. Do this a quickly as possible because the child support is owed to her till the day you file.

You need to mention this to the judge who handled your child support payment sentence. Let him know that you now have the child becuz of the abandonment of his mother. Have the child also there with you. Proof is the best thing.

You have to go to the courts and petition a review of your child support case. They will acknowledge that you have full custody of your son and you will get a refund, if one is due.

tell support enforcement that the child is living with you, this should stop the payments.

You'll have to go to an attorney to get it done. Presumably, since you are divorced, I'm guessing you had an attorney help you then, right? Go back to them on it.
