Pretty much everything from the 19th century and earlier is in the public domain. How about something by Edgar Allen Poe?

Check out Project Gutenburg for Public Domain works. Also check Wikipedia for "Short Stories by Year" and work your way back from 1923

Individuals who write for their profession need to get paid to feed their families (just like musicians...that's why people shouldn't steal music); I doubt you'll find any copyright-free fiction.

Why not try writing one yourself?
