yes, if he was married and never divorced, he is still married to the other women,

no other marriage would be valid, and in reality he is guilty of bigomy by marring to women.

So if you are the new "wife" he needs to get a divorce and remarry you.

My understanding of the question is that this man married one woman in the past and never divorced. Now, he wants to marry a second woman or tried to. It doesn't matter if the man married the first time in one state and now wants to get married (or tried to get married) in a second state. All marriages in any state are honored by all the other states.

If that is the question, the man is still legally married to the first woman and any marriage to the second woman is void. Therefore, the man must get a divorce from the first woman. Depending on the state, he is likely legally separated from his first wife. However, there is a major split among the states regarding marital and separate property (although if there isn't much money from either the man or the first wife, I wouldn't worry about it) and who gets what upon the divorce. Additionally, there are little details that are different in each state. As such, the man should consult a very good attorney. Additionally, if he tried to marry the second woman and he knew he was legally married to someone else and the second women didn't know about it, there may be criminal and civil penalties. You can't marry two wives in most states (probably all, but I haven't considered what the deal is with those polygamist groups in Utah and Arizona).

In any divorce action, it is a matter of law, a judge will make a decree, enter it in to record and now that ruling is precedent. Either way, all those rulings that Judges make become a matter of public record, except for Juvenile or Family Court when there are minors involved. This is the primary action, things that have to be done legally to be divorced. If he never filed the documents, guess what...... he's not divorced just dreamin'! Moreover, he should be responsible about this and take care of business.

Sounds like he needs to file the divorce. He can't marry someone else. Unfortunately, while there is common law marriage still in about 15 states, there is no such thing as a common law divorce in any state.
