Hi there....
GPS phones can be set two ways... 1) To send GPS data on only 911 calls, or 2) To send GPS data continuously. If you set your GPS phone to only send data on 911 calls, that would be the only time the phone will send GPS information. I work in engineering for a wireless carrier in the US, and our equipment does not register GPS location information unless the handset is sending GPS data continuously and only then, by order or subpoena from law enforcement.

Yes! Most cell phones have a GPS tracking function but the only people that use it are the police when you call 911. I'm pretty sure that's the only people that can track you but I bet the cell phones companies could see where you are if they really wanted to.
